Principais aspectos da nova regulamentação do Cadastro Ambiental Rural (CAR)

Abstract

O presente artigo objetiva consolidar os principais aspectos da legislação que regulamentou o Cadastro Ambiental Rural (CAR), bem como identificar eventuais dúvidas e conclusões iniciais que possam impactar o trabalho operacional do BNDES, em especial com os recursos do Fundo Amazônia. Dessa forma, abordam-se os aspectos gerais relativos ao CAR, ao Sistema de Cadastro Ambiental Rural (Sicar) e ao Programa de Regularização Ambiental (PRA); as principais regras estabelecidas pelo Código Florestal para a regularização do passivo ambiental dos imóveis rurais; os prazos para a inscrição no CAR e a efetivação desse cadastro nos estados da Amazônia; e os regimes especiais do CAR. Conclui-se, destacando-se, dentre outros aspectos, que o grande desafio do CAR no Brasil parece ser sua fase de validação pelos órgãos ambientais competentes.

The objective of this work is to consolidate the main aspects of the Rural Environmental Registry (CAR) legislation, as well as identify questions and initial conclusions that may affect the operational work of the Brazilian Development Bank (BNDES), especially in relation to resources from the Amazon Fund. In this sense, the work exposes general aspects of the CAR, the Rural Environmental Registry System (SICAR) and Environmental Adjustment Program (PRA); the main rules established by the Forest Code for the settlement of environmental liabilities in rural properties; deadlines for registration in the CAR and the implementation of the CAR in the Amazon states; and the special CAR regimes. And, in conclusion, highlights that the biggest challenge the CAR faces in Brazil seems to be the validation by the competent environmental authorities.
