Análise econômica de contratos: elementos para discussão em setores de infra-estrutura

Abstract

The present article argues the role of contracts on coordinating economic transactions, especially on specific assets investments. Asset specificity created an associated quasi-rent; the hold-up problem is strategic to appropriate this quasi-rent. The main impact of this problem is the under-investment in asset specific. Strategies of appropriation of this quasi-rent can make impracticable investment projects. Infrastructure sectors are typical example of as investments can depend on the contractual structures capability to mitigate the risks of appropriation of quasi-rent. Thus, classic contractual models are discussed in this paper in order to evaluate its differences in terms of incentives for the contracting parties.
